合同争议
合同争议是指合同当事人对于自己与他人之间的权利行使、义务履行与利益分配有不同的观点、意见、请求的法律事实。合同关系的实质是，通过设定当事人的权利义务在合同当事人之间进行资源配置。而在法律设定的权利义务框架中，权利与义务是互相对称的。一方的权利即是另一方的义务；反之亦然。一旦义务人怠于或拒绝履行自己应尽的义务，则其与权利人之间的法律纠纷势必在所难免。在某些情况下，合同法律关系当事人都无意违反法律的规定或者合同的约定；但由于他们对于引发相互间法律关系的法律事实有着不同的看法和理解，也容易酿成合同争议。在某些情况下，由于合同立法中法律漏洞的存在，也会导致当事人对于合同法律关系和合同法律事实的解释互不一致。总之，有合同活动，就会有合同争议。丝毫不产生合同争议的市场经济社会是不存在。
